 Short sales have been around for many years but only recently have they become a topic of conversation suitable for cocktail parties and sporting events. A short sale transaction occurs when a mortgage lender, (and sometimes other junior lien holders), agree to release their lien on a property for less money than the sum that is owed to pay the debt in full.  Florida has long been known for holiday or vacation properties, retirement, and sunshine. In the real estate boom years 2003-2005, Florida became known as the place to invest and resell property for a quick profit. Sadly as the boom came to a crashing halt at the end of 2005, Florida saw a dramatic decrease in real estate activity. As buyers tightened their finances in 2006, homeowners and investors desperately needed to sell. Thus, 2007-2009 will be remembered as the years of foreclosures and short sales. A mentor once told me that when a buyer wants to buy and a seller wants to sell it doesn’t matter if the purchase and sale contract is written in crayon with typos, mistakes and conflicting clauses. The closing will be a smooth success. On the other hand, he said if a buyer or seller wants out of the contract they can probably get out of what seemed to be an iron-clad contract.
